Terms of Service
FinchWorks policies regarding work are listed below. Please review before any payments.
Description of Service
I agree that I am paying for the services listed on the invoice and described therein. Services will be provided in a timely manner and necessary proofs, edits, and inquiries will be addressed before completion of service.
Refund/Cancellation
A full refund will be issued if a payment is made by the customer toward any service or job for which we do not actually perform any work or incur any costs. Cancelling before any work is completed will allow customers to receive full refunds except in the case of deposits to secure the service (Service Deposits).
Service deposits are non-refundable and are considered fully earned, as they are intended to cover the administrative costs for reviewing the job, doing any research, beginning any brainstorming and providing any estimate.
If partial work is performed or we incur any costs related to a specific service we will evaluate our costs as it relates to that same specific service and we will seek to reach an agreement with the customer for a refund, whether it is a partial refund or a full refund.
In cases where the work on a specific service is performed to completion, there will be no refunds issued. If there are any problems with the work we performed we will take necessary action to correct the problems in a timely manner.
If service includes procurement of printed materials or other such products, FinchWorks Creations will refund the reimbursed amount of those materials. Any broker fees charged are non-refundable to cover time costs of procurement.
Force Majeure
FinchWorks Creations shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that FinchWorks Creations will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that FinchWorks Creations cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
